These Terms of Use ("Terms") govern your access to and use of the Wine-ish mobile application ("App"), developed by The Hue Society ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the App.
You may create an account with the App ("Account") by providing your email address, password, and optionally, your full name and profile picture. You are responsible for maintaining the confidentiality of your account information, including your password. You are also responsible for all activity that occurs under your account.
The App may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content or practices of any third-party websites or services. When you click on a third-party link, you leave the App and are subject to the terms and conditions of that third party.
The App and all content and materials included in the App (including text, graphics, logos, images, audio clips, video clips, and software) are protected by copyright, trademark, and other intellectual property laws. You may not use any content or materials on the App without our prior written permission.
The App is provided "as is" and without warranty of any kind, express or implied. We disclaim all warranties, including, but not limited to, the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.
We shall not be liable for any damages arising out of your use of the App, including, but not limited to, direct, indirect, incidental, consequential, or punitive damages.
We may terminate your access to the App at any time, for any reason, without notice.
These Terms shall be governed by and construed in accordance with the laws of South Carolina, without regard to its conflict of law provisions.
These Terms constitute the entire agreement between you and us regarding your use of the App.
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the App. You are responsible for checking these Terms periodically for changes. Your continued use of the App following the posting of changes constitutes acceptance of those changes.
